Guidance

Sponsor Licence (Formerly Tier 2 Sponsor Licence) Guidance

The Sponsor Licence, previously known as the Tier 2 Sponsor Licence, is a vital requirement for UK employers seeking to hire skilled workers from overseas. Recent updates to UK immigration rules have introduced the Skilled Worker visa route, replacing the Tier 2 (General) visa. Effective from January 1, 2021, all companies must hold a valid sponsor licence to employ skilled workers without UK work rights, including EEA and Swiss nationals and their family members without settled or pre-settled status under the EU Settlement Scheme. The Home Office's latest guidance outlines these changes, emphasising the importance of compliance with the new regulations. Obtaining and maintaining a sponsor licence is crucial for businesses looking to recruit international talent and navigate the evolving landscape of UK immigration.

Eligibility Criteria for Sponsor Licence

  • Genuine and Lawful Operation

To be eligible for a sponsor licence in the UK, organisations must demonstrate that they are genuine and legally operating entities within the country. This involves providing evidence of legitimate business activities, such as registrations, tax documents, and financial statements.

  • Compliance with Immigration Laws

Applicants must show a willingness to comply with immigration laws and regulations. This includes having suitable systems and processes in place to manage sponsorship duties effectively.

  • Key Personnel Suitability

The organisation's key personnel should not have any unspent criminal convictions or a history of immigration offenses. The UK Visas and Immigration (UKVI) may assess the organisation's history, conduct, and compliance with relevant laws.

  • HR Systems and Processes

Organisations must have appropriate human resources (HR) systems and processes to fulfill their sponsorship duties. This involves maintaining accurate employee records, monitoring sponsored workers' immigration status, and complying with reporting and record-keeping requirements.

  • Employment Practices

Demonstrating robust and non-discriminatory employment practices is crucial. Organisations should comply with relevant employment laws, including equal opportunities and minimum wage requirements.

  • Understanding Sponsorship Obligations

Applicants should have a good understanding of the UK's immigration rules and obligations associated with being a sponsor. This includes knowing how to fulfill sponsor duties, monitor sponsored workers, report changes to the immigration authority, and ensure compliance with immigration laws.

Documentation Requirements for Sponsor Licence

  • Genuine and Lawful Operation: To be eligible for a sponsor licence in the UK, organisations must demonstrate that they are genuine and legally operating entities within the country. This involves providing evidence of legitimate business activities, such as registrations, tax documents, and financial statements.

  • Organizational Information: Specification of the industry, weekday operating hours, and a current hierarchy chart of owners, directors, and board members.

  • Employee Details: Submission of a list containing names and job titles of all employees if the organization has 50 employees or fewer.

  • Contact Information: Providing contact details, including a landline telephone number and names of individuals with access to the email address used in the application.

  • Mandatory Documents: A minimum of four mandatory documents to demonstrate the organization's genuineness and lawful operation in the UK.

  • Additional Information for Skilled Workers: Specific information related to the roles to be sponsored, including job descriptions, CVs of potential hires, and details on unfilled vacancies.

Which type of sponsor licence?

A sponsor licence is a crucial document for businesses or organizations in the UK that wish to employ skilled workers from outside the country. Understanding the different types of sponsor licences available is essential for companies looking to navigate the immigration system effectively. Here is a concise and informative content piece on the types of sponsor licences.

  • Tier 2 General Sponsor Licence:

This type of licence allows businesses to sponsor skilled workers for long-term positions that cannot be filled by settled workers in the UK. It is suitable for employers looking to hire non-EEA nationals with job offers in skilled roles.

  • Tier 2 Intra-Company Transfer (ICT) Sponsor Licence

Designed for multinational companies, this licence enables the transfer of employees from overseas branches to the UK. It is ideal for organizations relocating staff temporarily or permanently within their company.

  • Tier 5 Temporary Worker Sponsor Licence

This licence permits employers to sponsor individuals for temporary work in specific categories such as creative and sporting, charity workers, religious workers, and more. It is suitable for short-term employment needs.

  • Tier 4 Student Sponsor Licence

Educational institutions can apply for this licence to sponsor international students studying in the UK. It allows universities, colleges, and schools to enroll students from outside the EEA.

  • Tier 2 Minister of Religion Sponsor Licence

Religious institutions can obtain this licence to sponsor ministers of religion, missionaries, or members of religious orders coming to work in the UK.

  • Tier 2 Sportsperson Sponsor Licence

Sports clubs and organizations can apply for this licence to sponsor elite athletes or coaches who are internationally established in their field.

What is a sponsor license?

A sponsorship licence (also sometimes called a 'sponsor licence') allows an employer to issue certificates of sponsorship to prospective employees from outside of the UK or within the UK (applicants can "switch" into the Skilled Worker visa from most other visa types, for example, Tier 4 Student and Tier 2 visas). This is a requirement for those employees to work legally in the UK for that employer.

How can my organisation apply for a sponsor licence?

A corporation must submit an online application form for a sponsor licence (formerly known as a Tier 2 sponsor licence) together with a minimum of four specified supporting papers as proof of its trading presence in the UK and a covering letter to provide background information about the company.

Occasionally, the Home Office may need extra paperwork to determine whether the compliance standards and sponsorship obligations will be fulfilled, such as documentation of the business' HR procedures. For instance, the Home Office may also conduct a compliance visit at the company's premises while evaluating the licence application.

  • Not meeting the sponsor licence compliance requirements.

  • Failure to respond in a timely manner to the Home Office's enquiries.

  • Concerns that your application is not genuine.

Sponsor Licence Question

Frequently Asked Questions

How long does it take to apply for a sponsor licence?

In most cases, sponsor licence applications are processed within 2 months. If you require a faster decision, you may be able to pay £500 for a decision within ten working days. The Home Office limits the number of these priority applications (a limited number are made available each day and are allocated on a first-come, first-served basis). Once you have submitted your application, you will be advised if you can use the priority application service and how to do so.

How long does a sponsor licence last?

Sponsor licences are issued for a period of 4 years, at which point employers need to apply for renewal.

What is sponsor licence Rating

An employer's sponsor licence can be rated either 'A' or 'B'. Businesses granted a new employer sponsorship licence will be A-rated. Later, where the Home Office has concerns that a business is not adhering to its sponsorship duties, it may downgrade a sponsor to a B rating. This means that they are unable to issue any new Certificates of Sponsorship and need to demonstrate to the Home Office that they have made any improvements requested before their A-rating can be regained. If a sponsor licence holder is downgraded to a B-rating and they do not prove to the Home Office that all compliance issues have been addressed, they may have their licence revoked entirely. In this situation, any sponsored workers would have their leave curtailed (shortened). It is imperative to engage the services of an immigration Solicitor who can help you to regain your sponsor licence.
